Comprehensive Estate, Probate, and Trust Appraisals

Settling an estate or managing a trust is a significant responsibility, often coming at an emotionally difficult time. Whether you are an executor, a trustee, or a family member, one of your primary duties is to determine the fair market value of the real estate involved. An accurate estate appraisal is essential for ensuring that assets are divided equitably, taxes are calculated correctly, and all legal obligations are met. At Wall Street Appraisals, we provide professional, legally defensible valuations designed to give you peace of mind during the estate settlement process.

Understanding Estate, Probate, and Trust Appraisals

While these terms are often used interchangeably, there are slight differences in how the appraisal is applied depending on the legal structure of the assets:

    • Estate Appraisal: A broad term for valuing a deceased person's property to establish its worth for tax purposes, equitable distribution among heirs, or preparation for sale.
    • Probate Appraisal: When a property is not held in a trust, it must go through the probate court system. Probate courts require a formal inventory of the deceased's assets, and an independent appraisal provides the court with the certified value needed to approve the estate settlement.
    • Trust Appraisal: Properties held within a living trust avoid probate, but the trustee still requires a formal appraisal to execute the terms of the trust, distribute assets to beneficiaries, or file necessary tax returns.

Why Establishing Fair Market Value is Critical

The foundation of any estate settlement appraisal is determining the true fair market value of the property. This valuation serves several crucial purposes. First, it ensures that all beneficiaries receive their fair and equitable share of the estate as dictated by the will or trust documents. If one heir wishes to keep the family home, the appraisal determines the exact amount they must pay to buy out the other heirs.

Second, the appraisal is often required for tax reporting. The IRS and state tax authorities have strict regulations regarding estate taxes and capital gains. Establishing the property's value protects the estate and its heirs from potential audits, penalties, or overpaying on taxes. A certified residential appraiser provides a well-documented, objective report that meets all state and federal requirements.

    Current-Date vs. Retrospective Valuations

Depending on the specific needs of the estate, we offer both current-date and retrospective valuations. A current-date appraisal determines the value of the property as of the day the appraiser inspects it, which is often needed if the property is about to be sold or bought out by a family member.

However, many estates require a valuation based on a specific date in the past. For a retrospective valuation as of the exact date of the owner's passing, please see our Date of Death Appraisal service. This specialized appraisal establishes the "step-up in basis," which is vital for minimizing capital gains taxes.

What Our Clients Have To Say

"Excellent experience from start to finish. The appraiser was extremely professional, punctual, and clearly very knowledgeable about the local market. The entire process was smooth and well-organized, and the report was detailed, thorough, and delivered quickly. He also took the time to answer questions and explain the process, which I really appreciated. It's rare to find someone who combines efficiency with this level of professionalism and attention to detail. Highly recommend to anyone who needs a reliable appraisal."

"Sam Sada, Wall Street Appraisals provided an excellent 18-page appraisal report for a recently inherited one bedroom Daly City condo. The market value concluded in the report was $405,000. Subsequently, the county assessment was received with a $510,000 market value. The county assessor was provided with Mr. Sada's appraisal report and said it would take a couple days to review. Within 15 minutes, the county assessor called and informed that the $510,000 county assessment would be changed to $400,000. This would not have happened without Mr. Sada's very detailed appraisal report covering all the necessary requirements (including many pictures resulting from an on-site inspection) for a quick assessment resolution. A property assessment appeal was avoided. Mr. Sada is highly recommended. His work product experience and professionalism dealing with the customer is commendable."
